discretionary leave to remain

Discretionary leave to remain is usually granted for a period of between 6 months to three years. Before the expiry of this leave the applicant is required to apply for further leave to remain within the Immigration Rules for an extension of stay.

If the applicant has accrued limited leave to remain in the United Kingdom for a period of six years consecutively, they will be eligible to apply for Indefinite Leave to Remain upon this basis provided the other requirements of the Immigration Rules in this area are met.

If the application is successful then the applicant will be granted Indefinite Leave to Remain and subsequently receive a visa conferring the same.

If the application is unsuccessful then the applicant will receive a refusal letter advising the reasons for the refusal. We will assess the merits of this and talk you through the reasons for refusal and advise you of your options at this stage.
