Since 2008 all businesses have to carry out relevant document checks prior to employing an individual. If businesses fail to carry out the checks then civil penalties could be applied to them.

In March 2008 the government introduced the Points Based System. This saw the biggest overhaul of the Immigration system in the UK for over 45 years. The Points Based System has replaced over 80 existing routes to work and study in the UK with five tiers. UK Employers who wish to sponsor a migrant to work in the UK must apply for a Tier 2 or a Tier 5 sponsorship license from the UK Border Agency.
